The Community Defense and Anti-Mercenary Amendment

 


Section 1. The right of individual, natural persons to keep and bear arms for the defense of self, family, and community shall not be infringed.
Section 2. No corporation, limited liability company, partnership, nonprofit organization, religious organization, or other artificial entity, foreign or domestic, shall fund, compensate, equip, organize, train, direct, endorse, or otherwise sponsor any armed body of persons, except for forces raised, regulated, and directly accountable to the People through their elected federal, state, tribal, or local governments.
Section 3. Community defense associations shall be lawful only where service is voluntary and uncompensated in any form; where the association receives no funding, endorsement, or material support from any entity described in Section 2; where the association claims no employees and appears on no tax filing as payor or payee; and where the association is accountable to, and removable by, the residents of the community it serves.
Section 4. No person or entity shall contract for, provide, or receive private military, paramilitary, policing, detention, border enforcement, or revenue-collection services by force of arms within the United States or its territories. Sovereign functions — policing, detention, taxation, and border administration — shall not be delegated, contracted, or sold to private entities.
Section 5. No private entity, nor any person acting on behalf of, funded by, or contracted to a private entity, shall conduct mass or indiscriminate surveillance of the public — including but not limited to bulk collection of location data, biometric identification, facial recognition, communications interception, financial tracking, or the aggregation and purchase of such data from third parties. No information obtained through such surveillance shall be admissible as evidence against any person in any criminal, civil, or administrative proceeding, nor shall it serve as the basis for any warrant, detention, or enforcement action. Governments shall not circumvent this section, nor any constitutional protection, by purchasing, subpoenaing, or otherwise acquiring from private entities surveillance data they would be prohibited from collecting directly.
Section 6. Licensure to conduct investigative work shall be issued only to individual, natural persons, each of whom shall be personally and individually accountable at law for their conduct. No corporation, limited liability company, partnership, nonprofit organization, or other artificial entity shall be registered, licensed, or otherwise recognized as a private investigator or investigative agency, nor shall any such entity direct, employ, or contract investigative services in a manner that obscures the identity or personal liability of the licensed individual performing them. Investigative licensure shall not be transferable, assignable, or held in trust by any artificial entity.
Section 7. No artificial intelligence system, algorithm, predictive model, or automated analysis of behavior, association, movement, speech, or purchase history shall be used by any government or private entity to predict criminal conduct, generate suspicion, justify arrest or detention, deny bail or release, or otherwise subject any person to enforcement action for an act not yet committed. No output of such a system shall constitute probable cause, reasonable suspicion, or admissible evidence in any proceeding. Punishment shall attach only to conduct, proven by evidence, after due process of law — never to prediction.
Section 8. Any officer of the United States or of any State who authorizes, funds, or pardons conduct prohibited by this article shall be subject to removal and permanent disqualification from office.
Section 9. Congress and the several States shall have the power to enforce this article by appropriate legislation.
